Proposed KCMO Landfill - City Council Actions

Since learning of the validity of a proposed landfill within the city limits of Kansas City, located between 155th Street and 150 Highway, and Horridge Road on the west to Peterson Road on the east, City Council has dedicated a tremendous amount of time and resources toward learning the facts and taking a position regarding a proposed landfill. Once the information was confirmed, the City expressed opposition to the location of the landfill. 

The 150 Highway corridor is important to our community and if developed, it should be with residential and mixed-use commercial developments similar to communities in the surrounding areas. The first step is to prevent the development of a landfill along this corridor. Below is a timeline of actions taken in opposition to the proposed landfill.

 

Timeline of Actions Taken

May 6, 2024: Governor Parson signs HB1751 
HB 1751 barring the Missouri Department of Natural Resources from issuing permits to a landfill without the approval of cities within one mile was signed by Governor Parson.
April 23, 2024: Missouri House Approves HB1751
HB1751 passed the House with a vote of 121-25. The bill now heads to Gov. Mike Parson's desk for his signature. The bill would bar the Missouri Department of Natural Resources from issuing permits to a landfill without the approval of cities within one mile.
April 17, 2024: Missouri Senate passes HB 1751 
HB 1751 passed the Senate with a vote of 24-7. The bill was amended and now returns to the House for final passage. 
April 15, 2024: Raymore City Council Approves a Settlement Agreement With Landfill Developer
Raymore City Council unanimously approved a settlement agreement with the landfill developer. The agreement is contingent upon the passage of landfill legislation which would allow a municipality bordering Kansas City to approve or reject a landfill within one mile of its border.

March 7, 2024: Missouri House Passes HB 1751 
HB 1751 passed the House with a vote of 112 - 30. The bill prohibits the Department of Natural Resources from issuing a permit for the operation of a solid waste disposal area if the site is within one mile of an adjoining municipality without its approval. The bill now moves to the Senate.

January 10, 2024: Mid-America Regional Council Releases a Regional Landfill Capacity Study
The Mid-Americal Regional Council (MARC) retained Burns & McDonnell Engineering Company, Inc. to develop a Regional Landfill Capacity Study to forecast regional landfill capacity. The study is intended to inform solid waste planning, programming, and permitting activities at the state, regional and local levels and to serve as a prelude to a potential future formal solid waste plan.

January 9, 2024: Lee's Summit City Council Passes Resolution
City Council passed a resolution expressing the council's opposition to the location of a landfill or other facility involved in solid waste hauling near the City’s border. Council supports legislation that would give the City and other government entities significant input into the siting of a landfill or other facility involved in solid waste hauling.

June 15, 2023: KC City Council Passes Ordinance
Kansas City City Council passed an ordinance declaring a moratorium until June 1, 2024, on the approval of any permits, plan review, project plans, and zoning changes, where the subject matter of the project is a proposed waste-related use, including but not limited to a demolition debris landfill, solid waste separation facility or transfer station, or sanitary landfill.
May 16, 2023: Health Impact Assessment
The Jackson County Health Department released a report on the possible health impacts of a proposed landfill on the people living near the site in South Kansas City.

May 5, 2023: HB 19 Passes In the Senate
House Bill 19 passed in the Missouri Senate. An amendment attached to the legislation directs the Missouri Department of Natural Resources to conduct a health safety and welfare study for one year in the specific region of the Cass County and Jackson County border and provides that no permit to operate a solid waste processing facility or solid waste disposal area of a solid waste management system shall be processed during the study.
May 3, 2023: HB 909 Third Reading Stalled
The passage of HB 909 was stalled by a filibuster in the Missouri Senate. 
April 17, 2023: Missouri Senate Local Government Committee Votes Do Pass
The Missouri Senate Local Government Committee voted 5-1 to pass HB 909 and SB 590. The bills are now eligible to be voted on by the full Missouri Senate.

Mayor Baird attended and testified at a public hearing conducted by the Senate's Local Government Committee on HB 909 and SB 590.

April 3, 2023: Senate Bill 590 Second Reading
The Missouri Senate held a second reading for Senate Bill 590 and assigned it to the Local Government Committee.
March 22, 2023: HB 909 Approved by Missouri House
The Missouri House approved HB 909 in a 139-16 vote and advanced the bill to the Missouri Senate where it was first read on March 22.
March 7, 2023: Lee's Summit Economic Development Council Passes Resolution
The Lee's Summit Economic Development Council passes a resolution opposing the location of a landfill near the City's border. 
March 2, 2023: KC City Council Passes Resolution
The Kansas City City Council passed a resolution directing the city manager to perform an evaluation of the city's solid waste needs within six months and express opposition to any landfill in southeast Kansas City at this time. 
February 28, 2023: Jackson County Legislature Passes Resolution
The Jackson County Legislature adopted a resolution in opposition to the landfill in an 8-1 vote.
February 27, 2023: Missouri House Rules Administrative Oversight Committee Vote on HB 909
HB 909 came out of the Missouri House of Representatives Rules Administrative Oversight Committee with a unanimous vote in support of extending the statute to one mile.
February 22, 2023: Lee's Summit Chamber Passes Resolution
The Lee's Summit Chamber passed a resolution in opposition to the proposed landfill on 150 Highway.
February 21, 2023: Missouri House Local Government Committee Vote on HB 909
In a unanimous vote, the Missouri House Local Government Committee voted to advance HB 909 which places a one-mile buffer between new landfills and their neighboring communities. This would give Lee's Summit the ability to oppose and reject a landfill at our border.
February 21, 2023: Lee's Summit Elected Officials Meeting With State Representatives & Senators
Mayor Baird, Councilmembers Beto Lopez, Fred DeMoro, Mia Prier and City Manager Mark Dunning met individually with senators and representatives in Jefferson City to garner support for HB 909 giving Lee's Summit the ability to oppose and reject a landfill at our border. 
February 14, 2023: Lee's Summit Testifies at a Public Hearing in Jefferson City
Mayor Baird and numerous local officials from Raymore, Grandview, Lee's Summit R-7 School District and the Raintree Homeowners Association, testified in Jefferson City at a public hearing in favor of HB 909 to give Lee's Summit a seat at the table in landfill decisions at our gateway. HB 909 would require consent from Lee's Summit and Raymore to allow a landfill within one mile of our borders.
January 31, 2023: Lee's Summit Meeting With KC Mayor Quinton Lucas
Mayor Baird and Lee's Summit City Manager Mark Dunning met with Kansas City Mayor Quinton Lucas and City Manager Brian Platt to discuss our opposition to the proposed landfill. Mayor Baird offered to collaborate with Kansas City on how to develop the 150 Highway corridor for its highest and best use, such as residential and commercial development.
January 27, 2023: Government Relations Meeting With State Representatives & Senators
Mayor Baird and City councilmembers attended a governmental relations meeting to let Lee's Summit State Representatives Keri Ingle and Kemp Strickler, and Senator Mike Cierpoit know of our strong opposition and need for the support of HB909 giving Lee's Summit a say on landfills on our border. 
January 24, 2023: City of Grandview Passes Resolution
The Grandview Board of Aldermen unanimously passed a resolution opposing any landfill outside the city limits and near its borders.
January 24, 2023: Lee's Summit R-7 School District Passes Resolution
Our community partner, the Lee's Summit R-7 School District, passed a resolution in opposition to the landfill.
January 19, 2023: Lee's Summit City Council Passes Resolution
The Lee's Summit City Council unanimously passed a resolution expressing opposition to the location of a landfill outside the corporate City limits and near the border of the City.
